Typically, you will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive, or we may refuse to comply with your request in these circumstances.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of emails relating to purchases, subscription renewals and customer announcements relating to product/services such as technical notifications, service updates or other administrative communications.

What Personal Data we collect

Our service consists of generating digital content such as videos based on information (including text scripts, images and video) that you have chosen to upload to our application or service (such content, collectively, “User Content”). If you have chosen to do so, such User Content may contain information regarding yourself or others. Under applicable law, some or all of such User Content may constitute “Personal Data.”

Aggregated Data

We also collect, use and share “Aggregated Data” such as statistical or demographic data for any purpose. Aggregated Data may be derived from your Personal Data, but once in aggregated form it will not constitute Personal Data for the purposes of the GDPR as this data does not directly or indirectly reveal your identity.

No Special Categories of Personal Data

We do not knowingly or intentionally collect any “Special Categories of Personal Data” about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Where we need to process your Personal Data either to comply with law, or to perform the terms of an agreement that we have with you and you fail to provide that data when requested, we may not be able to perform the agreement we have or are trying to enter into with you. In this case, we may have to stop you using our Site but we will notify you if this is the case at the time.

Your User Content is not shared with third parties unless specifically requested by you. User Content may be hosted by third-party hosting providers (including Amazon Web Services). We may also use voice-cloning providers (including ElevenLabs) to clone your voice if you choose to create an avatar with our service.

How we keep your Personal Data secure

We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. We limit access to your Personal Data to those employees and other staff who have a business need to have such access. All such people are subject to a contractual duty of confidentiality.

We have put in place procedures to deal with any actual or suspected Personal Data breach. In the event of any such breach, we have systems in place to work with applicable regulators.

How long we store your Personal Data

We will retain Customer Data in accordance with a Customer’s instructions, including any applicable terms in a customer agreement and as required by applicable law. We will retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy.

This Site may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share your Personal Data. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our Site, we encourage you to read the privacy policy of every site you visit.

International Data Transfers

As a global business, it is sometimes necessary for us to transfer your Personal Data to countries other than your own, including the United States. When transferring data across borders, we take measures to comply with applicable data protection laws related to such transfer.

We comply with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce.

CraftStory is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Dispute Resolution

If you believe your Personal Data has been used in a way that is not consistent with this Privacy Policy, we invite you to contact us first at privacy@craftstory.com. We will make all efforts to resolve your complaints timely and accurately.

We have committed to cooperate with EU Data Protection Authorities (DPAs), the Swiss Federal Data Protection and Information Commissioner (FDPIC), and the UK Information Commissioner’s Office (ICO) to comply with the information and advice provided by such authorities with regard to data transferred from the EU, Switzerland, and the UK, respectively.

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
